TERMS AND CONDITIONS OF MARTELLO’S FLOODING REVIEW SERVICE
These terms and conditions govern the provision of a flood risk report service ("Service") facilitated by MyNestBox Limited (trading as Martello), a company registered in the United Kingdom, to its clients.
The Service involves the provision of a referral for a further flooding review report ("Report") from Ashfield Solutions. By ordering this Service, the client acknowledges and agrees to the terms set forth herein.
1.1 By clicking "Order" or equivalent, the client agrees to pay a fee of £175, plus Value Added Tax (VAT), for the Report to MyNestBox Limited (trading as Martello).
1.2 Invoicing for the Service will occur at the end of the month in which the Report is returned to the client.
1.3 Payment terms are strictly within 30 days of the invoice date.
1.4 MyNestBox (trading as Martello) reserve the right to charge interest on outstanding debt outside of the payment period at the base rate of the Bank of England.
2.1 The client acknowledges that it will take up to 3 working days for the Report to be completed and returned.
2.2 Within 3 working days and once the Report is ready, the completed report will be uploaded to the Martello system. The client will be notified via email.
3.1 The terms and conditions applicable to the Report are governed by Ashfield Solutions and can be found on their website at https://www.ashfieldsolutions.com.
3.2 The client agrees that MyNestBox Limited (trading as Martello) is not responsible for the contents of the report, which is solely prepared by Ashfield Solutions. Any results and advice therein given is provided solely by Ashfield Solutions.
4.1 Any complaints relating to the ordering of the product should be directed to support@martello.app.
4.2 Any complaints or issues related to the Report’s content or advice should be directed to Ashfield Solutions. MyNestBox Limited (trading as Martello) is not responsible for addressing such complaints or issues.
5.1 MyNestBox Limited (trading as Martello) will not be liable for any direct, indirect, incidental, or consequential damages that may result from the use of the Service or the Report and no claim against the Professional Indemnity Insurance of MyNestBox Limited (trading as Martello) is permitted.
6.1 MyNestBox Limited (trading as Martello) reserves the right to amend these terms and conditions at any time. Continued use of the Service will be deemed as acceptance of any amended terms and conditions.
7.1 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.
